Airvalon is an information and presentation platform for aircraft.

Important: No direct sale of aircraft takes place on Airvalon. We are:

• Not an online shop
• Not a marketplace for buyers and sellers
• Not a brokerage platform
• An information platform for presenting aircraft
• A directory of dealers with their contact details

1.3 Target Audience

The platform is available to consumers and commercial users (particularly aircraft dealers). Registration is only permitted for persons of legal age.

2. Registration and User Account (for Dealers)

2.1 Registration

Dealers can register on the platform to present aircraft. The following obligations apply during registration:

• Providing complete and truthful information
• Secure storage of access credentials (username and password)
• Immediate notification in case of suspected unauthorized use
• Compliance with applicable laws and these Terms of Service

2.2 Dealer Obligations

Dealers agree to:

• Only provide correct and up-to-date information about aircraft
• Only upload images and content for which they hold the rights
• Not publish misleading, false, or unlawful content
• Keep their contact information up to date

2.3 Suspension and Deletion of Accounts

The provider may suspend or delete user accounts in the following cases:

• Violation of these Terms of Service or applicable laws
• Providing false or misleading information
• Inappropriate behavior towards other users or the provider
• Suspicion of fraudulent activity
• Inactivity for a period of more than 3 years

3. Usage Rights and Uploaded Content

3.1 Grant of Rights

By uploading content (texts, images, videos, descriptions), the user grants the provider the following rights:

• Non-exclusive, worldwide, perpetual right of use
• Right to reproduce, distribute, and make publicly available
• Right to edit for purposes of display on the platform (e.g., scaling of images)
• Right to use in marketing and advertising materials of the platform

3.2 User Warranty

The user warrants that they hold all necessary rights to the uploaded content and that its publication does not infringe any third-party rights.

3.3 Liability for Content

The user is liable for all content they provide. The provider assumes no liability for the accuracy, completeness, or legality of user-generated content.

3.4 Editorial Catalog Content

The aircraft catalog on Airvalon serves exclusively editorial and informational purposes (reporting, product information, comparison). The following are used for this purpose:

• Official press material from aircraft manufacturers
• Images from licensed image archives and stock databases
• Media under Creative Commons or comparable licenses
• Own editorial photographs

Use is within the scope of editorial reporting pursuant to Section 50 UrhG (German Copyright Act) and within the framework of materials released by manufacturers for press purposes.

3.5 Images with Identifiable Persons

For dealers: When uploading images in which persons are identifiable, the user warrants that:

• The depicted persons have given their consent to publication (model release)
• No personality rights of third parties are violated
• For minors, the consent of legal guardians has been obtained

The provider recommends using images without identifiable persons or obtaining appropriate written consent.

3.6 Property Rights in Image Subjects

For images showing copyrighted works, trademarks, or clearly identifiable private buildings/properties (property release), the responsibility for obtaining the necessary permissions lies with the uploading user.

3.7 Reporting Copyright Infringement

If you believe that content on this platform infringes your copyright or other protective rights, please notify us immediately at:

The provider will promptly review legitimate complaints and remove the relevant content without delay.

4. Disclaimer and Warranty

4.1 No Brokerage or Sale

Airvalon does not broker or sell aircraft. The platform serves exclusively for information and presentation. The provider is not liable for:

• The availability, quality, or safety of presented aircraft
• The accuracy of information about aircraft
• The creditworthiness or reliability of presented dealers
• Transactions that occur between visitors and dealers

4.2 Platform Availability

The provider strives for uninterrupted platform availability but does not guarantee it. The platform may be temporarily unavailable for technical reasons or maintenance.

4.3 Limitation of Liability

The provider is only liable for intent and gross negligence. Liability for slight negligence is excluded unless essential contractual obligations (cardinal obligations) are violated.

Liability for damages arising from injury to life, body, or health, as well as under the Product Liability Act, remains unaffected.

5. External Links and Content

5.1 Links to Dealer Websites

The platform may contain links to dealer or third-party websites. The provider assumes no responsibility for the content, availability, or privacy practices of these external websites.

5.2 Embedded Content

The platform may contain embedded third-party content (e.g., YouTube videos). When using this content, the privacy policies of the respective providers apply.

6. Changes to Terms of Service

The provider reserves the right to change these Terms of Service at any time. Significant changes will be communicated to registered users by email.

Continued use of the platform after changes take effect constitutes acceptance of the modified Terms of Service. Users may object to changes within 4 weeks. In case of objection, the right to use the platform ends.

7. Termination and Contract Duration

7.1 Duration

The usage agreement is concluded for an indefinite period.

7.2 Ordinary Termination

Either party may terminate the agreement at any time without notice. Users can delete their account independently via the dashboard.

7.3 Extraordinary Termination

The provider may terminate the agreement extraordinarily in case of serious violations of these Terms of Service or applicable laws.

8. Data Protection

The processing of personal data is carried out in accordance with the Privacy Policy, which is an integral part of these Terms of Service.

9. Jurisdiction and Applicable Law

9.1 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

9.2 Jurisdiction

To the extent permitted by law, the place of jurisdiction for all disputes arising from this agreement is the provider's registered office (48488 Emsbüren).

For consumers: If the user is a consumer, the statutory rules of jurisdiction apply.

10. Severability Clause

Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
